R-404A
A ternary HFC blend of R-125, R-143a and R-134a, in a 10 kg refillable cylinder. The gas is not banned from sale: it may lawfully be bought and sold. What is restricted is the use of virgin gas to maintain or service refrigeration equipment — Article 13(3), since 1 January 2025, with a window to 1 January 2030 for reclaimed gas labelled under Article 12(7) and for recycled gas recovered by or for the same undertaking. Also restricted is the quantity of new gas placed on the market, which is limited by quota under Article 16. Import is not banned.

Identity and composition
R-404A is a ternary blend dominated by R-143a and R-125, two gases with very high GWP values, which is why the Annex VI weighted average reaches 3 922. That figure is exactly what puts it above the 2 500 threshold in Article 13(3). The threshold bites on using the gas for maintenance and servicing, not on trading it: reselling gas that is already on the market is not “placing on the market” within Article 3(6) and consumes no quota.

Who may buy
Fluorinated refrigerant gas is not an ordinary product. Article 11(6) of Regulation (EU) 2024/573 limits who may buy it for installation, maintenance, servicing or repair — and it binds the seller too.
